Q:    What errors in regards to vaccinations are most common in triggering legal issues?

A:    By far, proceeding on your own without first learning about your rights! Vaccine are required for school (public, private, home, military), in the military (members, families, civilian contractors), with immigration—at least the legal immigrants (also includes foreign adoption), at work (primarily healthcare workers at this time, but DHHS plans to vaccinate *all* US employees with the flu vaccines, and there are over *270 new vaccines* already seeking FDA approval or in clinical trials to follow that one!)—sometimes required by employers, and sometime by state law…

   The biggest problems usually concern religious exemptions, in situations where you have to state your beliefs (sometimes you do, sometimes you don’t). If you do, consult with a knowledgeable attorney *before* you submit your statement of beliefs. In my experience, most people who do this on their own fall into one or more legal pitfalls, because the law in this area isn’t consistent with most people’s common sense approach. Where I see the greatest need for legal assistance is with employees, immigrants, in the military, with college students doing healthcare curriculums that require doing clinical work in local facilities (state laws don’t apply in this situation), and with parents in custody disputes (in my experience with family law attorneys around the U.S., family law attorneys don’t know how to approach parent/child-custody vaccine disputes; there are legal arguments unique to this situation).

   Unfortunately, people often mistake what they think their rights *should* be with what they actually are. For example, with vaccines, we don’t have a legal right to decide what goes into our body, despite how strongly you or I feel that we should. So, as with any important legal issue, find out as much about your rights as you can BEFORE you act.

Q:   If you have been fully inoculated and the military loses your vaccination record is there anything you can do in order to avoid being inoculated again?

A:   Exercise an available exemption if you can. I expect that the military would see nothing wrong with vaccinating you again “just to be sure…” The military offers medical and administrative exemptions, and the latter includes religious exemptions. There are multi-branch regulations, and some branch-specific regulations.

   This can be tricky; most people in the military think there aren’t any exemptions, and they will not always cooperate with you. I got the Navy to agree to change their unlawful policy and banch-specific regulations, but they never followed through with that. So, it’s really hard to get an exemption there without my help, as you have to not only have a legally sound statement of beliefs, you have to go to the right person who has authority to tell your superior to allow you to have the exemption despite the (unlawful) regulations whose requirements are very hard to meet. Q:  What is the process to add a philosophical exemption to one’s state?

A.   The specific procedure varies from state to state and can most likely be found on your state’s legislative website. In general, whenever you have a legislative concern, it’s highly recommended to schedule a face-to-face meeting with your representative, as letters and emails will get lost in the shuffle unless they come in by the thousands. You should also prepare a concise, bullet-point list of facts with cites (references to the medical literature, etc.) to go over briefly and leave with your representative. Q:  How can you verify that there is a genuine and significant outbreak when the local school sends a letter attesting to an outbreak with a suggestion of immediate vaccination?

A:  Call the local health department. While there’s no guarantee that they will always know or be forthcoming if they do know, you can ask questions like, “Can you confirm the local outbreak reported in ?”  Were the disease cases confirmed by laboratory specimens? What was the vaccination status of the diseased persons, and was this confirmed?”

Q:    In hopes of bypassing harmful fillers can a homeopathic vaccine be in used in place of the vaccines offered at the health department?

A:   To the best of my knowledge, homeoprophylaxis – the use of specific homeopathic remedies in the same function as immunizations – is not a legal option anywhere in the U.S. that vaccines are required. However, it can be a useful adjunct for those exercising a legal exemption who want something more to protect themselves or their children from infectious disease than good nutrition, vitamin supplements (many doctors recommend C and D in particular), etc. See this article about how Cuba used homeoprophlyaxis with 2.5 million citizens to address a leptospirosis outbreak in the fall of 2008—they has substantially better results than with immunizations for a fraction of the cost, and homeopathy doesn’t injure or kill anyone!

Q:    Are there situations when waivers are acceptable to WHO when entering countries that require vaccines?  If so, what is the process?

A:    Vaccines for international travel are governed by the World Health Organization’s International Health Regulations:

   The only required vaccine is for yellow fever, for travelers going in and out of countries in sub-Saharan Africa and tropical South America. Unfortunately, the only recognized exemption is medical. The CDC recommends a boatload of other vaccines for international travel, but they are only recommendations, not requirements. If an employer is requiring vaccines for work-related travel, you can probably avoid them under federal civil rights law. However, there is not an exemption per se, only a right to religious freedom more generally, so it’s best to work with an experienced attorney in that situation.
