An Introduction to Vaccine Exemptions  

Everywhere routine vaccines are mandated in the United States, one or more exemptions are allowed.

     Everywhere vaccines are mandated, at least some people may be eligible to refuse them legally without penalty. Exceptions to vaccine mandates fall into three basic categories:

1. Medical: Generally available whenever vaccines pose a serious risk of harm to the intended recipient. Usually, they require a recommendation from a licensed medical doctor. Some authorities can deny medical exemptions even when recommended by a licensed medical doctor.

2. Religious: Available to most people who have sincerely held religious objections. Specific qualifying criteria may vary with different state or federal laws. These are offered in 48 states and in all federal jurisdictions.

3. Personal or Philosophical: Available to some people with personal or philosophical objections. Offered in about U.S. 20 states for students and in Maine for healthcare workers, but not in any federal jurisdictions or contexts.

DO YOU NEED AN ATTORNEY?

     No one is required to hire an attorney to exercise a legal right. However, making informed decisions requires having a sufficient understanding of your rights, and there are few short-answer vaccine exemption questions. Vaccine exemption and waiver law is more complicated than most people realize. Many people end up spending a lot of money paying an attorney to try to get them out of a problem they could have avoided altogether if they had only consulted an attorney ahead of time.

     The two best ways to make informed decisions on vaccine exemptions and waivers are to consult an experienced attorney, and/or purchase The Authoritative Guide to Vaccine Legal Exemptions e-book. Beware of Internet advice. Even highly reputable sites, including those of alternative medical doctors and vaccine book authors, provide information about vaccine rights that is usually a mixture of accurate and inaccurate information. Some who have relied on anti-vaccine websites have lost exemption rights unnecessarily. If it doesn’t come from an attorney experienced in this area of the law, beware!

Q:   Can you complete waivers if you want to pick and choose which vaccinations your pet undergoes?

A:  About a dozen states have medical exemptions for dogs, but that’s it. Pets don’t have religious beliefs, and they are considered “chattel”—property—under the law, for the most part. But first, determine what vaccines are required by law and which ones are merely recommended (for your veterinarian’s and big pharma’s financial gain). Beyond that, it’s probably up to a vet to decide, though the option to pick and choose could vary from state to state depending on the specific wording of each state’s laws.

   Very few states allow “pick and choose” for school exemptions. While such an option might be inferred in any state with a philosophical exemption, if it’s not clearly spelled out, you can’t necessarily make the assumption that it’s a legal option. Similarly, delayed vaccines, even where supported by a doctor, may not be a legal option. Remember—we don’t get to decide how to interpret the law—that’s the job of the courts. So, if you’re not sure about the interpretation of your state’s law, consider consulting an attorney about the matter. Every state has “statutory construction” rules or laws that explain how to interpret each state’s statutes. Legally, either those rules and/or legal precedent will answer the question; and if there is a formal dispute, then a judge may ultimately have to decide.

   I really like what Colorado has, a form that allows you to check exactly which vaccines you are refusing, and to indicate whether or not the refusal is for religious or philosophical reasons. You can’t get much more flexible than that! Odd, though, that Colorado state law also requires healthcare workers to get flu vaccines and offers *no* exemption option for that. There is a right to refuse for religious reasons, however, under federal civil rights law.

Q:   How is the vaccine court different from other U.S. courts?

A:   The “vaccine courts” are a division of the Court of Federal Claims that address only vaccine injury compensation claims, and nothing else. They have “special masters” instead of judges, and have their own unique procedural rules. They are the only option vaccine victims have for any kind of compensation for their injury, or their families for their death when a vaccines kills someone. At last check, only about 26% of applicants get compensated. The system was created by the National Childhood Injury Compensation Act of 1986, and supposedly to make it easier for vaccine victims to get compensation, but in practice it has become harder and harder to get compensation, and instead of being much quicker than state courts, it can take much longer, from what I’ve heard. Still, the system pays out $100 million annually, and this is despite the fact that the FDA and CDC say that only 1 – 10% of serious adverse events ever get reported in the first place. So, the system is, at least in the minds of vaccine injury advocates, in dire need of revision. A recent hearing to review the problems was postponed…

Q:    In hopes of bypassing harmful fillers can a homeopathic vaccine be in used in place of the vaccines offered at the health department?

A:   To the best of my knowledge, homeoprophylaxis – the use of specific homeopathic remedies in the same function as immunizations – is not a legal option anywhere in the U.S. that vaccines are required. However, it can be a useful adjunct for those exercising a legal exemption who want something more to protect themselves or their children from infectious disease than good nutrition, vitamin supplements (many doctors recommend C and D in particular), etc. See this article about how Cuba used homeoprophlyaxis with 2.5 million citizens to address a leptospirosis outbreak in the fall of 2008—they has substantially better results than with immunizations for a fraction of the cost, and homeopathy doesn’t injure or kill anyone!

Q:    Are there situations when waivers are acceptable to WHO when entering countries that require vaccines?  If so, what is the process?

A:    Vaccines for international travel are governed by the World Health Organization’s International Health Regulations:

   The only required vaccine is for yellow fever, for travelers going in and out of countries in sub-Saharan Africa and tropical South America. Unfortunately, the only recognized exemption is medical. The CDC recommends a boatload of other vaccines for international travel, but they are only recommendations, not requirements. If an employer is requiring vaccines for work-related travel, you can probably avoid them under federal civil rights law. However, there is not an exemption per se, only a right to religious freedom more generally, so it’s best to work with an experienced attorney in that situation.

The only way to be certain that Thirmerosol (Mercury) is not present in your vaccine is to check the insert. All too often a parent is told it is not in the vaccine only to find it listed when they check the insert. I have heard and seen this surprise many individuals including medical personnel. What’s the harm in checking especially when you view the harm in injecting.

It’s good to know there are many different ways to clear our bodies of this heavy metal. Personally, I did this many years ago and found that I enjoyed an overall better feeling of health and a significant increase in my energy.
